MINUTES OF THE CITY COUNCIL MEETING HELD ON APRIL 27, 2009
The meeting was called to order by Mayor Gary Koerner at 7:01 P.M. with all council members present at roll call except Dawn Thompson. Staff members present were Steve Reynolds, Corey Edgington, Dave Jenkins, Gordon Beck, Katie Taylor, Jeff Clawson and Sue Marcum.
Committee minutes were removed from the consent agenda. Included on the consent agenda were the April 6, 2009 Council Minutes and a listing of invoices payable in the total amount of $283,052.79. Motion was made by Shirley and second was given by T. A. to approve the consent agenda. Roll call: Dawn Hanafin-abstain, Nancy Bentley-yes, Dave McClelland-yes, John Haney-yes, Shirley Chancellor-yes, Steve Dean-yes, T. A. Whitsitt-yes. Motion carried, 6 yeas, 0 nays and 1 abstain.
Minutes of the Zoning Board of Appeals for the hearing held on April 9, 2009 were approved and the reading waived on a motion made by Shirley and seconded by Steve. Roll call: Dawn Hanafin-yes, Nancy Bentley-yes, Dave McClelland-yes, John Haney-yes, Shirley Chancellor-yes, Steve Dean-yes, T. A. Whitsitt-yes. Motion carried, 7 yeas, 0 nays.
Ordinance No. 09-04-01-51, An ordinance approving a variation of rear yard setback requirements of the Municipal Code of the City of Le Roy, Illinois, 2003 Title 10-Zoning, (301 S. Allen St.) passed on a motion made by Shirley and seconded by T. A. Roll call: Dawn Hanafin-yes, Nancy Bentley-yes, Dave McClelland-yes, John Haney-yes, Shirley Chancellor-yes, Steve Dean-yes, T. A. Whitsitt-yes. Motion carried, 7 yeas, 0 nays.
Dawn Thompson was seated at 7:11 P.M.
Ordinance No. 09-04-02-51, An ordinance approving a variation of rear yard setback requirements of the Municipal Code of the City of Le Roy, Illinois, 2003 Title 10-Zoning, (303 S. Allen St.) passed on a motion made by Shirley and seconded by Steve. Roll call: Dawn Hanafin-yes, Nancy Bentley-yes, Dave McClelland-yes, Dawn Thompson-yes, John Haney-yes, Shirley Chancellor-yes, Steve Dean-yes, T. A. Whitsitt-yes. Motion carried, 8 yeas, 0 nays.
Motion was made by Shirley and seconded by Dawn T. to approve the following Mid-Year Budget Adjustments for Fiscal Year 2008-2009:
1. Transfer $9,826 of .5% sales tax from the General Fund to the RCA Fund. This will zero out the revenue from line item 01-000-410.
2. Adjust the budget by transferring the original $150,000 of .5% sales tax from the General Fund to the RCA Fund.
3. Transfer $90,000 from the TIF 1 Fund to the General Fund. These funds are being transferred to reimburse the General Fund for TIF related costs associated with the Kiwanis Park electrical project and the new courts at Bowman Park.

The mayor and city council members received a letter from Francis Smith requesting the $300.00 donation given to the city in 2006 to be used for expenses to construct a bike path be returned to him. Motion was made by Steve and seconded by Shirley to approve the payment of $300.00 from the General Fund to Francis Smith to return his donation. Roll call: Dawn Hanafin-yes, Nancy Bentley-yes, Dave McClelland-yes, Dawn Thompson-yes, John Haney-yes, Shirley Chancellor-yes, Steve Dean-yes, T. A. Whitsitt-yes. Motion carried, 8 yeas, 0 nays.
Motion was made by Dawn T. and second given by Steve to enter executive session at 7:59 P.M. to discuss 5 ILCS 120/2 (c) (1), Personnel, and (11) Litigation. Roll call: Dawn Hanafin-yes, Nancy Bentley-yes, Dave McClelland-yes, Dawn Thompson-yes, John Haney-yes, Shirley Chancellor-yes, Steve Dean-yes, T. A. Whitsitt-yes. Motion carried, 8 yeas, 0 nays.
