MINUTES OF THE COUNCIL MEETING
HELD ON FEBRUARY 5, 2007
The meeting was called to order at 7:00 P.M. by Acting Mayor Dave McClelland
with all council members present at roll call except T. A. Whitsitt. Staff members
present were Steve Reynolds, Mike Bennett, Jeff Clawson and Sue Marcum.
Minutes of the council meeting held on January 15, 2007 were approved on a motion made by Jerry, seconded by Butch. Roll call: John Haney-yes, Gary Koerner-yes, Jerry Henson-yes, Butch Cook-yes, Shirley Chancellor-yes, Dawn Thompson-yes, Dave McClelland-yes. Motion carried 7 yeas, 0 nays.
A public hearing was called by the Acting Mayor at 7:20 P.M. for the purpose to allow for public comments regarding the Sales Tax Referendum Ordinance. There were members of the public in attendance and no comments were made. The hearing closed at 7:22 P.M.
Ordinance No. 07-02-01-10, An Ordinance providing for and requiring the submission of the proposition of imposing a non-home rule municipal retailers’ occupation tax and non-home rule municipal service occupation tax to the voters of the City of Le Roy, McLean County, Illinois, at the consolidated election to be held on the 17th day of April, 2007 was passed on a motion made by Jerry, second was given by Dawn. Roll call: John Haney-yes, Gary Koerner-yes, Jerry Henson-yes, Butch Cook-yes, Shirley Chancellor-yes, Dawn Thompson-yes, Dave McClelland-yes. Motion carried 7 yeas, 0 nays.
Motion was made by Jerry, second was given by Shirley to approve the minutes of the meeting of the City Council held on the 5th day of February, 2007, insofar as the same relates to the adoption of Ordinance No. 07-02-01-10 entitled: An Ordinance providing for and requiring the submission of the proposition of imposing a non-home rule municipal retailers’ occupation tax and non-home rule municipal service occupation tax to the voters of the City of le Roy, McLean County, Illinois, at the consolidated election to be held on the 17th day of April, 2007. Roll call: John Haney-yes, Gary Koerner-yes, Jerry Henson-yes, Butch Cook-yes, Shirley Chancellor-yes, Dawn Thompson-yes, Dave McClelland-yes. Motion carried 7 yeas, 0 nays.
Minutes of the meeting held 02/05/07 continued.
Motion was made by Gary, second was given by Shirley approving the Certification
of Minutes prepared for the County Clerk of the County of McLean, Illinois,
which relates to the adoption of Ordinance No. 07-02-01-10, An Ordinance providing
for and requiring the submission of the proposition of imposing a non-home rule
municipal retailers’ occupation tax and non-home rule municipal service
occupation tax to the voters of the City of le Roy, McLean County, Illinois,
at the consolidated election to be held on the 17th day of April, 2007. Roll
call: John Haney-yes, Gary Koerner-yes, Jerry Henson-yes, Butch Cook-yes, Shirley
Chancellor-yes, Dawn Thompson-yes, Dave McClelland-yes. Motion carried 7 yeas,

Ordinance No. 07-02-02-10, An Ordinance amending Title 3; Chapter 3 of the Municipal Code of Le Roy, Illinois, 2003 (3-3-4 Application for License; Fees) was passed on a motion made by Jerry, second was made by Gary. Roll call: John Haney-yes, Gary Koerner-yes, Jerry Henson-yes, Butch Cook-yes, Shirley Chancellor-yes, Dawn Thompson-yes, Dave McClelland-yes. Motion carried 7 yeas, 0 nays.
Motion was made by John, second was given by Dawn to hire Dustin Wiesemann as patrolman contingent upon his successful completion of all pre-employment requirements. Roll call: John Haney-yes, Gary Koerner-yes, Jerry Henson-yes, Butch Cook-yes, Shirley Chancellor-yes, Dawn Thompson-yes, Dave McClelland-yes. Motion carried 7 yeas, 0 nays.
Listed invoices in the total amount of $119,451.86 were approved for payment on a motion made by Jerry, second was given by Butch. Roll call: John Haney-yes, Gary Koerner-yes, Jerry Henson-yes, Butch Cook-yes, Shirley Chancellor-yes, Dawn Thompson-yes, Dave McClelland-yes. Motion carried 7 yeas, 0 nays.
Dave McClelland appointed Don Jenkins to fill the vacancy due to the recent passing of Charles Kumler on the Zoning Board of Appeals. Motion was made by Dawn, seconded by Shirley to accept the appointment by the Acting Mayor. Roll call: John Haney-yes, Gary Koerner-yes, Jerry Henson-yes, Butch Cook-yes, Shirley Chancellor-yes, Dawn Thompson-yes, Dave McClelland-yes. Motion carried 7 yeas, 0 nays.
Motion was made by John, seconded by Dawn to enter executive session at 7:37 P.M. to discuss 5 ILCS 120/2 (c) (2), Collective Bargaining and to discuss 5 ILCS 120/2 (c) (5), purchase of real property. Roll call: John Haney-yes, Gary Koerner-yes, Jerry Henson-yes, Butch Cook-yes, Shirley Chancellor-yes, Dawn Thompson-yes, Dave McClelland-yes. Motion carried 7 yeas, 0 nays.
Minutes of the meeting held on 02/05/07 continued.
Motion was made by Dawn, second was given by Shirley to adjourn the executive
session and return to regular session at 8:50 P.M. Roll call: John Haney-yes,
Gary Koerner-yes, Jerry Henson-yes, Butch Cook-yes, Shirley Chancellor-yes,
Dawn Thompson-yes, Dave McClelland-yes. Motion carried 7 yeas, 0 nays.
Text amendments to Title 9, Building and Title 10, Zoning Regulations had been submitted to the council for their review. After discussion, staff was directed to research changes in zoning definitions further.
