MINUTES OF THE REGULAR COUNCIL MEETING
HELD DECEMBER 6, 2004
The meeting was called to order by Mayor Robert Rice at 7:00 P.M. with all council members present except Dave McClelland and Gary Koerner. Staff members present were Steve Reynolds, Ralph Jungles Jr., Jeff Clawson and Sue Marcum.
Minutes of the November 15, 2004 Council Meeting were approved on a motion made by Jerry, second by Butch. Roll call: John Haney-yes, Butch Cook-yes, Jerry Henson-yes, T. A. Whitsitt-yes, Theresa O’Hare-yes, Dawn Thompson-yes. Motion carried 6 yeas, 0 nays.
On December 20th at 6:30 P.M. before the council meeting, Perry Mayer will be giving a demonstration of the new water plant operation on the laptop.
A public hearing to discuss a proposed property tax increase for the City of Le Roy for the year 2005 was opened by the Mayor at 7:15 P.M. No comments were given by the public. The hearing was closed at 7:21.
Minutes of the Budget and Finance Committee meeting held November 15, 2004 were read by Jerry.
Ordinance No. 04-12-01-10, An ordinance levying taxes for corporate purposes for the current year commencing on the first day of May, 2005 and ending on the Thirtieth day of April, 2006 for the City of Le Roy, McLean County, Illinois, passed on a motion made by Jerry, second by Dawn. Roll call: John Haney-abstain, Butch Cook-yes, Jerry Henson-yes, T. A. Whitsitt-yes, Theresa O’Hare-yes, Dawn Thompson-yes. Motion carried 5 yeas, 0 nays, 1 abstain.
Ordinance No. 04-12-02-30, An ordinance extending the dates for completion of the
Le Roy 1st tax increment redevelopment plan and redevelopment projects was passed contingent upon review by the city attorney on a motion made by Butch, second by John. Roll call: John Haney-yes, Butch Cook-yes, Jerry Henson-yes, T. A. Whitsitt-yes, Theresa O’Hare-yes, Dawn Thompson-yes. Motion carried 6 yeas, 0 nays.
Motion was made by Jerry, second by T. A. to enter into a tax increment agreement with David Kraft. The City will pay all costs associated with razing the building immediately west of the Princess Theatre. The costs will include razing and removing and not include any asbestos or other hazardous material removal and/or disposal. This agreement will be based on David Kraft acquiring the building and meeting all city requirements specifically in reference to tax increment financing, parking, building and zoning. Roll call: John Haney-yes, Butch Cook-no, Jerry Henson-yes, T. A. Whitsitt-yes, Theresa O’Hare-yes, Dawn Thompson-yes. Motion carried 5 yeas, 1 nay.
Ordinance No. 04-12-03-70, An ordinance prohibiting possession or consumption of alcohol by persons under 21 years of age and establishing related enforcement procedures was passed on a motion made by John, second by Butch. Roll call: John Haney-yes, Butch Cook-yes, Jerry Henson-yes, T. A. Whitsitt-yes, Theresa O’Hare-yes, Dawn Thompson-yes. Motion carried 6 yeas, 0 nays.
Ordinance No. 04-12-04-70, An ordinance amending the use of citations to enforce city ordinances was passed on a motion made by John, second by Dawn. Roll call: John Haney-yes, Butch Cook-yes, Jerry Henson-yes, T. A. Whitsitt-yes, Theresa O’Hare-yes, Dawn Thompson-yes. Motion carried 6 yeas, 0 nays.
Theresa read the minutes of the Utility Committee meeting held on November 22, 2004.
Motion was made by Theresa, second by Dawn to approve the revised proposal from Patrick Engineering dated November 23, 2004 which replaces the proposal approved at the November 15, 2004 regular Council Meeting. Roll call: John Haney-yes, Butch Cook-yes, Jerry Henson-yes, T. A. Whitsitt-yes, Theresa O’Hare-yes, Dawn Thompson-yes. Motion carried 6 yeas, 0 nays.
Listed invoices in the amount of $247,936.29 were approved for payment on a motion made by Jerry, second by T. A. Roll call: John Haney-yes, Butch Cook-yes, Jerry Henson-yes, T. A. Whitsitt-yes, Theresa O’Hare-yes, Dawn Thompson-yes. Motion carried 6 yeas, 0 nays.
Special mention of appreciation was given to Scott Bryant and John Reynolds for their help in the plowing of city streets during the recent snowstorm.
