MINUTES OF THE REGULAR COUNCIL
MEETING
HELD SEPTEMBER 2, 2003
The meeting was called to order by Mayor Robert Rice at 7:00 P.M. with all council
members present at roll call except Gary Koerner and Dave McClelland.
Staff members present were Jeff Clawson, Vicki Moreland and City Attorney David
Stanczak.
Minutes of the regular council meeting held August 18, 2003 were approved on
the motion made by Jerry, second by Theresa. Roll call: John Haney-yes,
Butch Cook-yes, Jerry Henson-yes, Chad Farischon-yes, Theresa O’Hare-yes,
Dawn Thompson-yes. Motion carried 6 yeas, 0 nays.
Perry Lewis, from Lewis, Yockey and Brown Engineering reported that the asphalt
work had been done and the shoulder work would be done this week.
Motion was made by Jerry, second by John to allow 50% reimbursement up to $65,000.00
in Tax Increment Financing funds for the purpose of renovating the property
located at 300 E. Center Street. The $65,000.00 will be based on an initial
investment in land acquisition and renovation costs of at least $130,000.00
by the developer.
The distribution will be considered a 0% loan forgiven if the facility remains
viable for three years. For each month the building is left empty after
the initial distribution, the City will require reimbursement of 1/36 of the
total paid to the developer. Roll call: John Haney-yes, Butch Cook-yes,

A Public Hearing was opened at 7:15 P.M. by Mayor Rice to accept public input
on the annexation of the Bishop Estates. No public input was received.
Hearing was closed at 7:16 P.M.
A Public Hearing was opened at 7:17 P.M. by Mayor Rice to accept public comment
on the annexation of Le Roy School District property. No public input
was received. Hearing was closed at 7:18 P.M.
Motion was made by Jerry, second by Butch to approve the annexation agreement
between the City of Le Roy and Jack and Beverly Burcham. Roll call: John
Haney-yes, Butch Cook-yes, Jerry Henson-yes, Chad Farischon-yes, Theresa O’Hare-yes,
Dawn Thompson-yes. Motion carried 6 yeas, 0 nays.
Ordinance No. 03-09-01-50, An ordinance annexing certain territory
to the City Of Le Roy, McLean County, Illinois (Territory to be Annexed being
located in a part of the NE 1⁄4 of the NW 1⁄4 of Section 28, Township
22 North, Range 4 East of the Third Principal Meridian, McLean County, Illinois
(Bishop Estates) was passed on a motion made by Jerry, second by Dawn.
Roll call: John Haney-yes, Butch Cook-yes, Jerry Henson-yes, Chad Farischon-yes,
Theresa O’Hare-yes, Dawn Thompson-yes. Motion carried 6 yeas, 0
nays.
Ordinance No. 03-09-02-50, An ordinance annexing certain territory
to the City of Le Roy, McLean County, Illinois (Le Roy School District #2) (Territory
to be Annexed being located in Deed Book 440 on recorder of deeds office lying
southwesterly of S.B.I. Route 39 (US Route 150) and Lying East of the West Line
of the E1/2 of The SE1/4 of Section 21, all in Township 22 North, Range 4 East
of the Third Principal Meridian, McLean County, Illinois was passed on a motion
made by Dawn, second by Butch. Roll call: John Haney-yes, Butch
Cook-yes, Jerry Henson-yes, Chad Farischon-yes, Theresa O’Hare-yes, Dawn
Thompson-yes. Motion carried 6 yeas, 0 nays.
Motion was made by John, second by Theresa to accept the pay scale for Non-Certified
and Certified Patrol officers. Roll call: John Haney-yes, Butch

Thompson-yes. Motion carried 6 yeas, 0 nays.
Ordinance No. 03-09-03-51, An Ordinance Approving Variances
as requested on Real Estate as described herein in the City of Le Roy, McLean
County, Illinois (Bishop Estates) was passed on a motion made by Jerry, second
by Chad. Roll call: John Haney-yes, Butch Cook-yes, Jerry Henson-yes,
Chad Farischon-yes, Theresa O’Hare-yes, Dawn Thompson-yes. Motion
carried 6 yeas, 0 nays.
Ordinance No. 03-09-04-51, An Ordinance Amending the Municipal
Code of the City of Le Roy, Illinois 2003 Title 10, Zoning Map Amendment (Bishop
Estates) was passed on a motion by Theresa, second by John. Roll call:
John Haney-yes, Butch Cook-yes, Jerry Henson-yes, Chad Farischon-yes, Theresa
O’Hare-yes, Dawn Thompson-yes. Motion carried 6 yeas, 0 nays.
A motion was made by Butch, second by Dawn to accept the West Nile Virus Control
Intergovernmental Agreement between the City of Le Roy and McLean County Board
of Health. Roll call: John Haney-yes, Butch Cook-yes, Jerry Henson-yes,
Chad Farischon-yes, Theresa O’Hare-yes, Dawn Thompson-yes. Motion
carried 6 yeas, 0 nays.
Resolution No. 03-09-01-91, A Resolution of the City of Le
Roy Supporting the Railbanking of Norfolk & Southern Right-of-Way from Mansfield,
IL to Bloomington, IL was passed on a motion by Jerry, second by Theresa. Roll
call: John Haney-yes, Butch Cook-yes, Jerry Henson-yes, Chad Farischon-yes,
Theresa O’Hare-yes, Dawn Thompson-yes. Motion carried 6 yeas, 0
nays.
Motion was made by John, second by Dawn to spend up to $8,000.00 for the topographical
study for the landfill closure process. Roll call: John Haney-yes,
Butch Cook-yes, Jerry Henson-yes, Chad Farischon-yes, Theresa O’Hare-yes,
Dawn Thompson-yes. Motion carried 6 yeas, 0 nays.
Listed invoices in the total amount of $15,739.58 were approved for payment
on the motion by John, second by Chad. Roll call: John Haney-yes,

Dawn Thompson-yes. Motion carried 6 yeas, 0 nays.
Motion was made by Dawn, second by Jerry to enter executive session at 8:00
P.M. to discuss personnel, 5ILCS 120/2(c) (11). Roll call: John

Dawn Thompson-yes. Motion carried 6 yeas, 0 nays.
Motion was made by Dawn, second by Jerry to adjourn the executive session at
8:30 P.M. and return to regular session. Roll call: John Haney-yes,

Discussion was held concerning the request from LEAS for a tax increment financing
agreement with the City of Le Roy.
